COMPLIANCE WITH COUNCIL

  1. Council compliance
      1. The Seller shall permit any officer employed by the relevant Local Government and any licenced builder, registered architect or engineer employed by the Buyer to enter and inspect the property and the interior and the exterior parts of the building or other structure forming part of the property.
      2. If at the Contract Date: –
    1. Any permission, consent of approval required from the Local Authority or other body having jurisdiction for the construction of the improvements on the land: –

(i) Has not been obtained; or

(ii) Having been obtained, has not been complied with in all respects

Then either of such cases, if same is not disclosed on the face of the Contract, the Buyer may terminate this Contract by notice in writing to the Seller given within ** days of the Contract Date.

    1. The Land and improvements do not strictly comply with any provision, stipulation or requirement of any Commonwealth, State of Local Government Statue, Act, Regulation, or Local Law and non-compliance is not disclosed on the face of the Contract, the Buyer may terminate this Contract by notice in writing to the Seller given within ** days from the date of the Contract.
